Early political spats suggest nothing off-limits

WASHINGTON (AP) ? The early border skirmishes of Campaign 2012 are reviving questions about one candidate’s former pastor and shining a spotlight on the other’s high school hijinks. Can a fresh round of questions about President Barack Obama‘s birth certificate be far behind?

In a campaign year when voters have declared the economy their top concern, Obama and Mitt Romney are on notice that there’s no statute of limitations on the issues or conduct that might be used against them. And there’s sure to be somebody with money or other means to insert even low-threshold matters into the political dialogue.

“It’s open season,” says Eric Dezenhall, an expert on crisis management. “This is going to be very rough.”

Thursday’s disclosure that a Republican-leaning super PAC was considering a $10 million ad campaign highlighting Obama‘s past links to inflammatory preacher Jeremiah Wright was just the latest evidence that if there ever were limits on what was fair game in a campaign, they’re largely history.

That’s thanks to a flood of new money into politics, the ease of spreading political attacks via the Internet and changing attitudes about what’s an appropriate topic for discussion. Long gone are the days when candidates’ extramarital escapades were off-limits, photographers avoided taking pictures of Franklin D. Roosevelt in a wheelchair and a few newspapers and TV stations acted as gatekeepers.

The New York Times quoted backers of this year’s Wright ad proposal as aiming to “do exactly what John McCain would not let us do” in the 2008 campaign.

Romney repudiated the Wright plan, as did the super PAC financier weighing it. Nonetheless, Obama‘s campaign accused Romney of refusing to “stand up to the most extreme voices in the Republican Party” and the president’s supporters were happy to associate Romney with what campaign strategist David Axelrod called the “purveyors of slime.”

McCain, the 2008 GOP nominee, spoke out forcefully during the campaign four years ago against efforts to use Wright’s provocative speeches against Obama, and the issue largely subsided. But since then, a series of court cases has cleared the way for an onslaught of campaign ads from outside groups seeking to influence elections.

Such so-called super PACs can be a megaphone for matters that would have gotten less attention in the past, and still allow candidates to deny they’re involved.

But outside messengers who do the dirty work in campaigns are nothing new in presidential politics. Democrat Michael Dukakis in 1988 was the target of an infamous outside ad about a furloughed rapist named Willie Horton. Democrat John Kerry in 2004 saw his record as a Vietnam War hero mischaracterized and used against him by the outside group Swift Boat Veterans for Truth.

Political historian Evan Cornog, author of “The Power and the Story,” said the staying power of a particular issue or charge usually depends on whether it jibes with the public’s understanding of a candidate.

“We are addicted to narratives, and if something fits with the story, it’s going to get some traction,” says Cornog. “A good political operative will have a fairly good sense of what will work and what will not work.”

Both sides are experiencing this in real time:

?Questions about Romney’s bad behavior toward classmates during his high school years, revealed in a recent Washington Post article, are being used to reinforce the profile that Romney’s critics have tried to create of the GOP candidate as a corporate bully. The Democratic National Committee circulated the Post article and highlighted just one sentence about Romney’s behavior: “It was vicious.”

?Questions about Obama’s ties to his former preacher’s incendiary rhetoric about America and about whether the president was truly born in Hawaii and is a Christian fit with broader efforts to paint Obama as radically different from most Americans. Romney earlier this year told an interviewer, “I’m not sure which is worse, him listening to Reverend Wright or him saying that we must be a less Christian nation.” That was a reference to remarks in which Obama actually did not promote a less Christian nation but observed growing religious diversity in the U.S.

When something nicely fits with the profile that one side or the other is trying to build, it may endure long after a question has been duly asked and answered.

Questions about the validity of Obama’s Hawaii birth certificate, for example, have been widely discredited, but they keep popping up. Donald Trump and Texas Gov. Rick Perry both toyed with it during the presidential primaries. A poll last May, after Obama had released his detailed Hawaii birth certificate, found that a third of Americans still thought he might have been born elsewhere or said they didn’t know.

Cornog points to plenty of positive aspects to the free-wheeling exchange of ideas and information allowed by a broad variety of news sources and the Internet but also has a warning: “If you enter an age in which you have elective belief systems independent of fact, you have a problem for your political world.”

It has stainless steel Kitchenaid appliances, with a stove in the island a double oven, and plenty of counter space.? There is ample room for a large dining table and seats at the island.? The colors of the wood floor, granite countertops, cupboards and tile backsplash all coordinate nicely with each other, giving a warm, homey feeling to the room.

In a recent paper on the role of mitochondria and type II diabetes, the researchers conclude that:

Impaired mitochondrial plasticity, that is, response to metabolic regulation, seems to be characteristic of many insulin-resistant patient groups. Whereas inherited mitochondrial abnormalities have been associated with insulin resistance, acquired metabolic alterations typical of insulin resistance, such as hyperglycemia, hyperinsulinemia and hypertriglyceridemia, can also promote the production of ROS and damage mitochondria in insulin-responsive tissues. Of note, some successful interventions to decrease insulin resistance also improve features of mitochondria, making these organelles attractive candidates for novel therapeutic approaches.

In other words, it?s better to have as much mitochondria as you can get. But what are these little gadgets called mitochondria?

In cell biology, a mitochondrion (plural mitochondria) is a membrane-enclosed organelle found in most eukaryotic cells.[1] These organelles range from 0.5 to 1.0 micrometer (?m) in diameter. Mitochondria are sometimes described as ?cellular power plants? because they generate most of the cell?s supply of adenosine triphosphate (ATP), used as a source of chemical energy.[2] In addition to supplying cellular energy, mitochondria are involved in a range of other processes, such as signaling, cellular differentiation, cell death, as well as the control of the cell cycle and cell growth.[3] Mitochondria have been implicated in several human diseases, including mitochondrial disorders[4] and cardiac dysfunction,[5] and may play a role in the aging process. The word mitochondrion comes from the Greek ????? mitos, thread, + ???????? chondrion, granule.

Now, what is one of the best ways to go about increasing the total number of these gizmos so that you can enjoy more ATP meaning, energy, insulin sensitivity and a host of other metabolic goodies?

Several studies on resistance training have been shown to significantly increase the total amount of mitochondria within the skeletal muscles. One in particular, ?SuperSlow or Hypertrophy Resistance Training: do they affect skeletal muscle mass and strength differently??, showed a significant increase. Their findings:

The myofibrillar content of type I muscle fibres declines with both modes of resistance training (thereby to a greater extent with the SuperSlow regime) whereas it levels off in type IID fibres (with even a light increase with the SuperSlow mode). Both fibre types significantly increase their mitochondrial content and with it their aerobic capacity. In type I fibres this is mainly due to both a highly significant increase of the intermyofibrillar mitochondria and the hypertrophy mode of resistance training. In type IID fibres both subpopulations of mitochondria contribute to the overall increase of the mitochondrial amount. Furthermore, this training effect on mitochondria may point to a fibre shift towards type IIA.

In other words, if you want to maximize your mitochondria, get up off your ever-flattening keesters my good, good friends and start pumping iron ? preferably slowly and intensely.

Nevertheless, there is significant long term damage that can be caused by filing your own trademark, or relying on a one-size-fits-all service provided by non-attorneys.

It seems I have a constant of clients that have filed their own trademark applications, and some that have used non-attorney services. These clients are now up against some very tough rejections from the Trademark Office, or are having other difficulties with the trademark prosecution process. Inevitably, these clients wind up spending more money to pay an attorney to fix the application, or to re-file the application, than it would have cost to hire an experienced trademark attorney to file the application for them.

Trademark owners may believe that filing and prosecuting a trademark application it is a simple process. Admittedly, the filing of a trademark application is much more straight forward than the filing of a patent application. Further, an issued trademark can provide the trademark owner with significant protection for their intellectual property. Don?t believe me? Take a look at the trademark portfolio for ?Coca-Cola?. Coca-Cola has hundreds of trademarks and trademark applications in the United States alone. The Coca-Cola formulation is not protected by a patent, but the brand is protected by numerous trademarks. Anyone reading this that has ever had a Coca-Cola product will appreciate that they get the same exact Diet Coke if it is purchased in Minnesota or if it is purchased in Rhode Island (I chose the drink and these states at random by the way). Therein lies the value of a properly protected trademark. The consumer always knows the quality of the product they are buying when it is identified by a Coca-Cola trademark.

Trademarks are so important because they identify the source of a particular good or service. The trademark owner, if they do it right, has associated their good or service with a particular level of quality that they work hard to maintain. If the trademark owner does not protect their trademark, they may open themselves up to the danger of an inferior quality good or service being distributed under the same or similar name. Such acts cause consumer confusion in the marketplace. Therefore, it is not only important for the trademark owner to seek protection for their trademarks, but it is exceedingly important for the trademark owner to file the application properly. The trademark owner certainly should not rely on the Trademark Examining Attorney to help them through this process.

The safest bet is to hire an attorney familiar with trademark prosecution to handle protecting your trademark assets. Of course, this means paying a legal fee, but I believe the legal fees involved in having an experienced attorney prepare, file and prosecute a trademark application pale in comparison to the cost of not having a properly protected trademark. As noted above, this post is prompted by the recent increase I have encountered of fixing, or sometimes re-filing, trademark applications that have either been filed by the trademark owners themselves, by attorneys that do not specialize in trademark prosecution, or using the ?assistance? of some websites that purport to file trademark applications for the trademark owner, without providing legal advice.

Some of the most common issues that I have encountered stem from the trademark owner selecting an improper filing basis, or submitting an improper specimen, or even amending an application in a way that it should not have been amended (pursuant to some ?assistance? received from the Trademark Examining Attorney). The Trademark Examining Attorneys are professionals, but you need to remember it is not their job to help you get the best right possible, but rather it is their job to examine the application you have submitted. ?Just because the Trademark Examining Attorney at the Trademark Office makes a suggestion or a request does not mean that is what is best, or even preferable. The rules and regulations governing trademark applications are very specific, but some of the language in the rules is not easily understood by those without training. For example, a trademark is not eligible for registration on the Principal Register if it has not been used in interstate commerce.

I have encountered several trademark applications filed by the trademark owner that purport to have used the mark in commerce. The requirement to use a mark in interstate commerce means that the mark was used on the good or service across state lines. Many trademark owners may have only used their trademark within one state, but mistakenly file an application noting that the mark has been used in interstate commerce.

During prosecution, the Trademark Examining Attorney does not check to see if the mark was actually used in interstate commerce. Instead, the Trademark Examining Attorney checks to see if there are any conflicting marks in the Trademark Office records and, if not, assuming that the other trademark requirements are met, will allow the application. If the mark was not used in interstate commerce when the Trademark Examining Attorney allowed the mark, this could mean trouble for the trademark owner down the road. You may have acquired a trademark with little or no rights attached, which is a nightmare scenario.

An improperly filed application could be subject to cancellation, and is likely not to be enforceable. The moral of the story is that hiring an attorney to file a trademark application is not overly expensive, and is a good way to ensure that your trademark is properly filed and prosecuted. The last thing you want is to have saved a few hundred dollars representing yourself only to learn that the trademark you acquired is cancelled or not enforceable. The investment in business cards, letterhead, advertisements, signs, brochures and more could all be lost, so filing a trademark application yourself and saving a few hundred dollars may well cost you thousands of dollars down the road, which is not a good trade by any measure.
